1. Agreement to these terms
By accessing sightsaid.com, creating a checkout, or purchasing a product, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the store. You must be legally able to enter a binding agreement or use the store with the involvement of a parent or legal guardian.
2. Store information and product presentation
We aim to present product descriptions, images, sizes, colors, and pricing accurately. Screen settings, production methods, materials, and normal manufacturing variation may cause reasonable differences in appearance. Product availability and specifications may change without notice.
3. Orders and acceptance
Submitting payment does not require us to accept an order. We may decline, limit, or cancel an order for suspected fraud, pricing or inventory errors, payment problems, prohibited activity, or other legitimate operational reasons. If we cancel after collecting payment, we will initiate an appropriate refund.
4. Prices, promotions, taxes, and payment
Prices are shown in U.S. dollars unless stated otherwise. Shipping, taxes, and other applicable charges are shown during checkout when available. Promotions may be limited, modified, or withdrawn and cannot be combined unless expressly stated. Payments are processed by Stripe and are also subject to Stripe’s terms and privacy practices.
5. Shipping, delivery, returns, and order issues
Shipping methods and charges appear during checkout. Delivery dates are estimates and may be affected by carriers, address issues, weather, production timing, or events beyond our reasonable control. If an item arrives damaged, incorrect, or materially different from the order, contact hello@sightsaid.com promptly with the order information and supporting photos when applicable. Return or refund eligibility depends on the item, condition, production status, and applicable law. Nothing in these terms limits rights that cannot legally be waived.
6. Email and SMS communications
Transactional communications may be sent to process or support an order. Promotional email is sent according to the preferences associated with the contact. Promotional SMS requires separate consent; consent is not a condition of purchase. You can unsubscribe from marketing email or reply STOP to marketing texts.
7. Intellectual property
SIGHTSAID names, artwork, rebus concepts, product graphics, photography, copy, layout, and other store content are owned by or licensed to SIGHTSAID and are protected by applicable intellectual-property laws. No content may be copied, reproduced, modified, distributed, sold, or commercially exploited without prior written permission, except as law expressly permits.
8. Acceptable use
You may not interfere with the store, attempt unauthorized access, misuse checkout or promotional features, introduce harmful code, scrape the service in a disruptive manner, impersonate another person, violate law, or use the store to infringe another person’s rights.
9. Third-party services
The store relies on third-party services such as payment, messaging, hosting, production, and delivery providers. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party services or events outside our reasonable control.
10. Disclaimers and limitation of liability
To the fullest extent permitted by law, the store and its content are provided “as is” and “as available.” SIGHTSAID disclaims warranties not expressly stated. To the fullest extent permitted by law, SIGHTSAID will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the store. Any direct liability will not exceed the amount paid for the order giving rise to the claim. Some jurisdictions do not permit certain limitations, so they may not apply to you.
11. Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
